
Justice Ibrahim Kala of the Federal High Court in Lagos on Wednesday convicted and sentenced a businessman, Paul Uche, to five years in prison for importing and possessing counterfeit drugs: Matlamal Forte Tablets (Primary Package) with Diclofenac Potassium Entric Coated 50mg (Secondary Package).
Justice Kala handed down the sentence after the defendant entered into a plea bargain agreement with the National Agency for Food and Drug Administration and Control (NAFDAC).
As part of the plea agreement, the defendant pleaded guilty to a seven-count charge of possession, display, distribution, importation, and storage of adulterated, unregistered, and counterfeit medicines brought against him by NAFDAC.

The Agency informed the court that the offences occurred on or around August 29, 2025, at Victory Warehouse, Ilasa, Sadiku Bus Stop, along the Oshodi-Apapa Expressway, Lagos.
It further stated that the offences are contrary to Section 1(a) of the Counterfeit and Fake Drugs and Unwholesome Processed Foods (Miscellaneous Provision) Act, Cap. C34, LFN, 2004, and are punishable under Section 3(1)(a) of the same law.
During Wednesday’s hearing, prosecutor Banabars Simon notified the court that a seven-count charge was pending.
He also stated that both parties, aiming to avoid a lengthy trial, had agreed to a plea bargain, and that copies of the agreement had been filed with the court.
Simon then urged the judge to order the charge to be read so that the defendant could re-enter his plea to it.
The prosecutor reviewed the case facts by tendering all relevant documents and exhibits recovered from the defendant.
Following the defendant’s guilty plea and review of the facts, Simon requested that the court convict and sentence the defendant in line with the plea bargain reached with NAFDAC.
Justice Kala, after listening to the prosecutor and in the absence of any objection from defence counsel Mrs Oreofe Ogunleye, convicted and sentenced the defendant to five years in jail, effective from Wednesday.
The judge, however, granted the defendant the option of paying a fine of N500,000 on counts one to four and N50,000 on counts five to seven, totalling N2.5 million.
Additionally, Justice Kala ordered the defendant to serve 30 days of community service or, in the alternative, pay the monetary fines and perform community service.
